DMCA Report

1. Overview

FulfillNext respects the intellectual property rights of others and expects our users to do the same. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond promptly to claims of copyright infringement committed using our website.

2. Filing a DMCA Takedown Notice

If you believe that your copyrighted work has been copied and is accessible on our website in a way that constitutes copyright infringement, please provide our designated copyright agent with the following information:

• A physical or electronic signature of the copyright owner or a person authorized to act on their behalf
• Identification of the copyrighted work claimed to have been infringed, or if multiple copyrighted works are covered by a single notification, a representative list of such works
• Identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material (e.g., URL links)
• Your contact information, including your name, address, telephone number, and email address
• A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law
• A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed

3. Counter-Notification

If you believe that your content was wrongfully removed due to a DMCA takedown notice, you may file a counter-notification. Your counter-notification must include:

• Your physical or electronic signature
• Identification of the material that has been removed and the location at which it appeared before it was removed
• A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification
• Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district

4. Repeat Infringers

In accordance with the DMCA, FulfillNext has adopted a policy of terminating, in appropriate circumstances, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the website and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.

5. Good Faith

Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake, may be subject to liability for damages, including costs and attorney's fees.
